Acceptable Use Policy (AUP)

This Acceptable Use Policy (“AUP”) sets out the rules for how you may use the Withpema Platform and Services. It applies to all users, including Tribute Page administrators, signatories, donors, and service providers. By using Withpema, you agree to comply with this AUP in addition to our Terms of Service and Privacy Policy.

1. Purpose of Funds

Funds raised through Withpema must be used solely for memorial or funeral-related costs, such as:

• Funeral arrangements and associated expenses.

• Burial or cremation costs.

• Memorial events or vigils.

• Support for immediate family needs related to the funeral.

Funds may not be used for personal enrichment, business purposes, investment, or any unrelated expenses.

2. Prohibited Activities

You agree not to use Withpema for:

• Raising funds for purposes other than funerals or memorials.

• Fraudulent, deceptive, or misleading fundraising campaigns.

• Money laundering, terrorist financing, or any other unlawful financial activity.

• Uploading or sharing content that is abusive, defamatory, obscene, misleading, or infringing on intellectual property rights.

• Circumventing, disabling, or tampering with Withpema’s security or monitoring systems.

• Using multiple Tribute Pages or accounts to misrepresent fundraising activities.

3. Anti-Money Laundering (AML) & Fraud Prevention

Withpema is committed to complying with Kenyan AML and counter-terrorism financing laws.

All Tribute Page administrators and signatories must complete Know Your Customer (KYC) verification before withdrawals are permitted.

Any suspicious transaction may be flagged and withheld pending investigation.

One confirmed fraudulent transaction is sufficient grounds for Withpema to immediately:

• Suspend or terminate the Tribute Page,

• Close all user accounts linked to the Tribute Page, and

• Report the matter to relevant law enforcement or regulatory authorities.

4. Account & Memorial Page Suspension

Withpema reserves the right, at its sole discretion, to:

• Suspend or permanently close any account or Tribute Page found in violation of this AUP.

• Withhold or cancel withdrawals if fraud, AML concerns, or regulatory breaches are suspected.

• Ban repeat violators from creating or managing any future Tribute Pages.

5. Responsibility of Users

• Tribute Page administrators are responsible for ensuring funds are raised and used appropriately.

• Donors are responsible for verifying the authenticity of a Tribute Page before contributing.

• Service providers connected through Withpema must deliver services honestly, without exploitation or fraud.

6. Monitoring & Enforcement

Withpema actively monitors campaigns for suspicious or prohibited activity.

• Violations of this AUP may result in account suspension, legal action, or reporting to authorities.

• Withpema reserves the right to update or modify this AUP at any time, and continued use of the Platform constitutes acceptance of such updates.
